Florida lawmakers are weighing a new bill that would protect medical marijuana patients from losing parental rights simply because they use cannabis legally. The proposal would bar courts from denying custody, visitation, or parenting time based solely on a parent’s status as a state-approved medical marijuana patient.
Supporters say the bill addresses a real problem: parents following the law have still faced scrutiny, investigations, or adverse custody decisions because cannabis use is often treated differently than other prescribed medications. Under the legislation, medical marijuana use alone could not be considered neglect, abuse, or a sign of unfitness as a parent.
The measure aims to align Florida’s family courts with the reality of its medical marijuana program, which now serves hundreds of thousands of patients. If passed, it would make clear that legally treating a medical condition shouldn’t come at the cost of custody—or weekend visitation.
