Florida’s marijuana legalization campaign just got sent back to the starting line.
State officials in Florida have reset the signature count for the Smart & Safe Florida ballot initiative to zero, wiping out hundreds of thousands of previously gathered petitions. The move comes after a new election law—signed by Gov. Ron DeSantis—changed the rules so that signatures can’t roll over into a new election cycle.
That means the campaign, backed by Smart & Safe Florida, now has to start from scratch if it hopes to get adult-use marijuana legalization in front of voters in a future election.
The situation is further complicated by ongoing legal battles. Campaign organizers are challenging the invalidation of tens of thousands of signatures and are asking the Florida Supreme Court to weigh in. At the same time, opponents of the measure are pressing their own legal arguments, while authorities continue investigating alleged irregularities in the petition-gathering process.
In short, what once looked like forward momentum has turned into procedural quicksand. Whether legalization advocates can recover will depend not just on their ability to collect new signatures—but on how the courts ultimately rule.
