In response to this outcome, advocates have initiated efforts for a new proposal targeting the 2026 ballot. This forthcoming amendment seeks to permit adults over the age of 21 to possess up to two ounces of marijuana and would authorize existing medical marijuana treatment centers to engage in the cultivation and sale of cannabis for recreational purposes.
Currently, the only legal avenue for cannabis use in Florida is through the state’s medical marijuana program. Residents diagnosed with qualifying medical conditions can apply for a Medical Marijuana ID Card, which grants them access to purchase and use medical cannabis.
Additionally, Florida has implemented stricter regulations on hemp-derived products. Effective March 12, 2025, the updated Hemp Extract Rule introduces more stringent packaging and marketing requirements, aiming to limit the appeal of such products, particularly to minors.
Given these developments, it appears that medical marijuana will remain the sole legal option for cannabis consumption in Florida for the foreseeable future.
