Some Kentuckians now have to pick between their Second Amendment rights and medical marijuana, with cardholders prohibited from gun ownership in the commonwealth.
Marijuana, which is currently classified as a Schedule I drug, although conversations around reclassification emerged earlier in the year, falls in the same category as substances like heroin. The Bureau of Alcohol, Tobacco, Firearms & Explosives says to comply with federal law, including that of the Controlled Substance Act, there are “no exceptions” to selling or owning guns when it comes to marijuana, including when “used for medicinal purposes” and when “such use is sanctioned by state law.”
It’s also prohibited to sell a firearm if there’s “reasonable cause to believe” the individual uses or abuses controlled substances, including ownership of “a card authorizing the possession and use of marijuana under State law,” the ATF says.
