A Detroit suburb’s attempt to invalidate an ordinance that allowed recreational marijuana sales failed because it sued to challenge the ballot initiative’s wording after voters approved it, a divided Michigan Court of Appeals said.
Officials from Royal Oak Township could have challenged the initiative’s wording before the favorable November 2022 election, the appeals court said Thursday. However, they didn’t sue until the following year, Judge Stephen L. Borrello wrote.
