RED BANK, NJ: The 2018 Farm Bill transformed the U.S. cannabis industry by legalizing hemp -defined as Cannabis sativa L with no more than 0.3% Delta-9 THC, the psychoactive compound in cannabis.
This change paved the way for hemp-derived products like CBD and indirectly fueled the rise of Delta-8 THC, a minor cannabinoid often synthesized from CBD.
What Is Delta-8 THC?
Delta-8, nicknamed “marijuana lite,” is a less intense alternative to Delta-9 THC. Popular for its milder effects, it offers a legal workaround in states where Delta-9 remains illegal. However, its legality is a gray area. The Farm Bill doesn’t address synthetic cannabinoids like Delta-8, leaving it technically legal but largely unregulated at the federal level.

This lack of oversight raises safety concerns. Delta-8 products, including edibles and vapes, may contain contaminants or inaccurate THC labeling, exposing consumers to risks. Additionally, Delta-8 remains under-researched, leaving long-term health effects unclear.
How New Jersey Leads in Consumer Safety
States have responded differently to Delta-8’s rise. New Jersey recently enacted legislation placing intoxicating hemp products, like Delta-8, under the Cannabis Regulatory Commission’s jurisdiction. The law mandates rigorous testing and labeling standards, ensuring consumer safety.
Until regulations are finalized, Delta-8 production and sales are paused, and only licensed vendors will be permitted to sell these products in the future.
