An unlicensed cannabis store located in Wayne County is being investigated after being accused of selling to underage customers.
According to the Attorney General’s office, an undercover investigator was able to purchase $200 worth of cannabis product for a minor undercover at the “I’m Stuck” store location in the town of Ontario.
David Tulley who owns the shop now states that although he is unlicensed, he is not a bad actor in the cannabis market. Tulley also believes he should be eligible for a conditional adult-use retail dispensary license, as he has several marijuana convictions on his record.
Tulley did not have the two year requirement of business experience a the time of his application to open his stores, which is a requirement to obtain a license in the State of New York. He also states that while he does not sell cannabis in his stores, he does give away free samples.
“We have never ever, ever not any one of us ever sold to minors; that has not ever happened. We’re a consulting and marketing firm. We educate the public about products and services. After a good education from “I’m stuck”, we give you a free sample, not to sell you a product but because the license stores aren’t talking to you about their products at all.” states David Tulley, owner of the store.
Tulley is expected to appear in Wayne County Court on August 2nd. If convicted, he could face millions of dollars in penalties.
